Wanneroo Liveability Survey Competition Terms and Conditions

Place Score 2023 Wanneroo Liveability Survey Competition

  1. The terms and conditions of this competition are governed by New South Wales law.
  2. The Promoter is Place Score Pty Limited of Suite 1-2, Level 5, 2-12 Foveaux Street, Surry Hills, NSW 2010, ABN 19 610 823 286.
  3. The Competition commences 22 May 2023 and final entries close and must be received by 11:59pm AEST on 30 July 2023 (“Competition Period”).

WHO CAN ENTER AND HOW

  1. To be eligible to enter:
    • Entrants must entirely complete the survey at placescore.org/wanneroo;
    • Tell us in 25 words or less “In 25 words or less, what is your BIG idea to make [your suburb] more liveable or enjoyable for you?” and “In 25 words or less, what is your SMALL idea to make [your suburb] more liveable or enjoyable for you?during the Competition Period;
    • Entry is only open to people at least 15 years old;
    • Entry is only open to Australian residents outside the ACT;
    • Only one entry is permitted per person.
  2. An entry is deemed to be received at the time of its receipt by the Promoter and not at the time of transmission by the entrant.
  3. Employees (and their immediate families) of the Promoter, Prezzee Pty Ltd and agencies associated with this promotion are ineligible to enter.

HOW WINNERS ARE DETERMINED AND NOTIFIED

  1. Winners will be randomly selected by the Promoter by 15 August 2023 at the Surry Hills office of the Promoter.
  2. Winners will be notified by email by 17 August 2023 (“Winner Notification Date”).
  3. The Promoter’s decision is final and no correspondence will be entered into.

PRIZES

  1. The winning entries will win one of ten $100 vouchers of your choice from one of Prezzee’s participating retailers. A full list of participating retailers is available at prezzee.com.au. Any ancillary costs associated with redeeming a prize are not included.
  2. If for any reason the prize winner does not take their prize or an element of their prize by 24 August 2023, then the prize or that element of the prize will be forfeited by the prize winner.
  3. If a prize is not accepted or claimed by the stipulated date, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the unclaimed prize to another randomly redrawn entry, as determined by the Promoter at its Surry Hills office in its absolute discretion, by 5pm on 7 September. Winners of unclaimed prizes will be notified in writing.
  4. If a prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with an alternative prize to the equal value and/or specification.

GENERAL TERMS (boring but important)

  1. Information on how to enter and prizes forms part of these conditions of entry. Submission of an entry is deemed acceptance of these conditions of entry.
  2. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry, who tampers with the entry process or who submits an entry that the Promoter, in its sole discretion, deems to be offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the competition.
  3. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. Errors and omissions will be accepted at the Promoter’s discretion.
  5. Incomplete, indecipherable, or illegible entries will be deemed invalid. Any incorrect entrant details submitted may render the corresponding entry invalid. It is each entrant’s responsibility to inform the Promoter if their personal details change prior to the Winner Notification Date.
  6. Each work submitted as part of an entry (“Work”) becomes the property of the Promoter. As a condition of entry, each entrant irrevocably grants to the Promoter a non-exclusive perpetual worldwide licence to use and exploit all intellectual property rights (including, without limitation, copyright) in and to the Work and consents to the Promoter doing (or omitting to do) any acts in respect of the Work which may otherwise constitute an infringement of an entrant’s moral rights. For the avoidance of doubt, the Promoter may use all or part of an entrant’s Work(s) for promotional, marketing or publicity purposes, whether in respect of the competition, the Promoter or otherwise. Each entrant warrants to the Promoter that the Work submitted is an original work of the entrant which does not infringe any rights of any third party. A breach of the warranty set out in this condition will result in the entrant’s entry being invalid. In addition, each entrant indemnifies the Promoter against all loss, damages and costs incurred by the Promoter arising from that entrant’s breach of the warranty set out in this condition.
  7. If for any reason whatsoever beyond the reasonable control of the Promoter, the competition is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) to cancel, suspend, modify, terminate or cancel the promotion.
  8. Unless otherwise stipulated, no prize is transferable, exchangeable or redeemable for cash.
  9. The Promoter, its associated agencies and companies and the agencies associated with this Competition will not be liable for any loss (including, without limitation, indirect, special, or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained in (whether or not arising from any person’s negligence) in connection with this Competition or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  10. As a condition of entry, each participant agrees to the Promoter using the entrant’s first name and entry in any media for an unlimited period of time without remuneration for the purpose of promoting this Competition (including any outcome).
  11. The collection, use and disclosure of personal information provided in connection with this Competition is further governed by the Promoter’s Privacy Policy which can be accessed here: www.placescore.org/privacy-policy.The Promoter collects personal information in order to conduct the competition and provide any goods/services requested and may, for that purpose, disclose such information to third parties, including, but not limited to, prize suppliers or a regulatory authority and for any purpose to which the entrant has previously consented.
  12. By entering the Competition, the entrant agrees, that without limitation:
    • the entrant is responsible for the content of their entry and for ensuring that the entry complies with these Terms and Conditions;
    • the content submitted is their own;
    • they will not submit material that is unlawful or fraudulent, defamatory, obscene, derogatory, that is in breach of any intellectual property, privacy, publicity or other rights;
    • they have complied with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and access to or use of others’ computers or computer systems.
